Terms & conditions

These Terms & Conditions describe our waiting list and the conditions intended for future purchases of products from Mindform Studio, a trading name of De Backer Business Solutions. This website currently accepts waiting-list signups only; it does not accept orders or payments.

1. Scope

These Terms & Conditions apply to purchases of Mindform Studio products by consumers and business customers.

Joining the waiting list is free, is not an order and does not reserve stock, guarantee delivery or create an obligation to buy. You can unsubscribe at any time. Ordering details will be shared when sales open. If a future purchase is made through Etsy, the applicable Etsy terms and platform procedures also apply.

If there is a conflict between these Terms & Conditions and mandatory consumer law, the mandatory consumer-law provisions will prevail.

2. Products and information

We make reasonable efforts to describe and display our products accurately.

Because products are physically manufactured, minor differences in appearance, finish, dimensions or colour may occur between individual products and between photographs and the delivered product. Such minor variations do not constitute a defect where they do not materially affect the normal use of the product.

Product images are illustrative and screen settings may affect how colours appear.

3. Orders

We will share the ordering process when products become available. You will be able to review the applicable price, shipping charges and purchase terms before placing an order. No payment is taken through this waiting-list website. Future orders may be cancelled before dispatch by contacting us; once dispatched, the return process applies.

The customer is responsible for ensuring that the information supplied when ordering, including the delivery address, is complete and accurate.

We reserve the right to cancel or refuse an order where we cannot reasonably fulfil it, where the product is unavailable, where there has been an obvious pricing or description error, or where we reasonably suspect fraud or misuse.

If an order that has already been paid is cancelled by us, amounts paid for the cancelled order will be refunded.

4. Prices and payment

The advertised Core Set price is €129 including VAT, excluding shipping. For a future order, the total price and applicable shipping charges will be shown before you commit to purchasing.

Payment methods will be specified when ordering becomes available. Joining the waiting list requires no payment details.

For international orders, customs duties, import taxes or similar charges may apply. Unless the relevant marketplace or applicable law provides otherwise, these charges are the responsibility of the customer.

5. Delivery

We plan to ship worldwide from the Netherlands. Shipping charges and destination-specific estimates will be confirmed before ordering. First delivery of the Core Set is planned for December 2026; this is not a guaranteed delivery date. We will inform the waiting list if the planned timing changes.

Estimated delivery periods are estimates and can be affected by circumstances outside our reasonable control, including postal or carrier delays, customs procedures and international transport disruptions.

Mandatory consumer rights relating to delivery times remain unaffected.

The customer is responsible for providing a correct and complete delivery address.

6. Returns — 30-day return period

Both consumers and professional/business customers may return eligible products within 30 days after delivery. This includes therapists and coaches purchasing for their practice.

This voluntary 30-day period is intended to provide consumers with a longer return period than the minimum statutory withdrawal period applicable to many online purchases.

To return a product, notify us within the 30-day period by emailing hello@mindformstudio.com.

After notifying us, return the product within 14 days to the return address provided by us.

Unless the product is defective, incorrect or otherwise required by applicable law, the customer is responsible for the direct cost of returning the product.

Customers may inspect a product as they reasonably would be able to do in a physical shop. If a product has been handled beyond what is necessary to establish its nature, characteristics and functioning, we may make a deduction for any resulting reduction in value where permitted by law.

7. Refunds

After a valid return, we will refund the amount due using the original payment method where possible. For consumers exercising their statutory right of withdrawal, refunds are due within 14 days of notification, subject to the right to await return of the goods or evidence of dispatch described below. For other returns under our voluntary policy, we will refund within 14 days of receiving the returned goods.

Where statutory withdrawal rules require it, the refund will include the cost of the least expensive standard delivery method offered for the original order.

For business returns and consumer returns outside the applicable statutory withdrawal period but within our voluntary 30-day return period, original shipping costs are not refundable unless required by applicable law.

We may wait to issue a refund until we have received the returned goods or the customer has provided adequate evidence that they have been returned, where permitted by law.

8. Business customers

Our voluntary 30-day return policy also applies to customers purchasing in the course of a business, trade or profession, on the return conditions described above.

This voluntary policy does not limit remedies for products that do not conform to the agreement.

9. Defective or incorrect products

If you receive an incorrect, damaged or defective product, contact us promptly with your order details and, where useful, photographs of the issue.

Nothing in these Terms & Conditions limits any mandatory legal rights relating to defective or non-conforming goods.

Where we are legally responsible for a defective or incorrect product, we will provide an appropriate remedy in accordance with applicable law.

10. Product use and safety

Customers must use Mindform Studio products in accordance with their intended purpose and any instructions or safety information supplied with the product.

When products are used by children during therapy, coaching or similar professional sessions, they should be used under appropriate adult or professional supervision.

11. Intellectual property

All intellectual-property rights relating to Mindform Studio, including our brand, product designs, photographs, illustrations, website content, written materials and other original materials, remain the property of Mindform Studio, De Backer Business Solutions or the relevant rights holder.

Purchase of a physical product does not transfer any intellectual-property rights in the product design or related materials.

Content may not be reproduced, commercially exploited, copied or distributed without prior permission where such permission is required by law.

12. Liability

Nothing in these Terms & Conditions excludes or restricts liability where doing so would be prohibited by applicable law.

Mindform Studio is not responsible for losses caused by use of a product contrary to its intended purpose, applicable safety information or reasonable professional practice.

For business customers, to the extent permitted by law, Mindform Studio will not be liable for indirect or consequential losses, loss of profit, loss of revenue or loss of business resulting from a purchase.

Any limitations in this section are subject to mandatory applicable law.

13. Force majeure

We are not responsible for delays or failure to perform obligations where this results from circumstances beyond our reasonable control, such as natural disasters, transport interruptions, government measures, strikes, major technical failures or comparable events.

This provision does not affect mandatory consumer rights.

14. Privacy

We process personal data in accordance with our Privacy Policy.

If a future purchase is made through Etsy, Etsy will also process personal data in accordance with its own privacy terms and policies.

15. Complaints

If you have a question or complaint about an order or product, please contact hello@mindformstudio.com.

Please include your order number and sufficient information for us to investigate the matter.

We aim to resolve complaints reasonably and promptly.

16. Governing law

These Terms & Conditions and agreements with Mindform Studio are governed by Dutch law.

For consumers, this choice of law does not deprive you of mandatory consumer protections that apply under the laws of your country of habitual residence where such protections cannot legally be excluded.

Disputes will be submitted to the competent courts in the Netherlands unless mandatory law provides the consumer with the right to bring proceedings elsewhere.

17. Changes

We may update these Terms & Conditions when our products, business processes or applicable legal requirements change.

The version applicable to an order is generally the version in effect when the order was placed, unless mandatory law requires otherwise.
